मज़ाक-मज़ाक में यह कहावत कहने वालों को क्या पता था कि एक दिन ऐसा आएगा जब इस कहावत पर गंभीरता से विचार किया जाने लगेगा. एक तरह से यह न्याय व्यवस्था पर कटाक्ष भी है जो बताती है कि यदि न्याय व्यवस्था में किसी पक्ष का स्नेही होता प्रतीत हो तो न्याय व्यवस्था से भरोसा उठने लगता है.
हमारे देश की न्याय व्यवस्था अपने हिसाब से चलती है. जजों की तो हमेशा से गुहार लगी रहती है कि न्याय व्यवस्था में न्यायाधीशों की कमी के कारण ही समय पर लोगों को न्याय नहीं मिल पाता. इस बीच यदि कोई बड़ा नेता गलती से पकड़ा भी जाता है तो इतने छेद तो मच्छरदानी में भी नहीं होते जितनी कमियां हमारे कानून में हैं. उन्हीं कमियों का कारण वे नेता बच निकलते हैं. ‘प्रभावशाली’ लोग कानूनी बेड़ियों से बचने में सफल होते हैं.
हाल ही में पूर्व वित्त मंत्री पी चिदंबरम और उनकी पत्नी नलिनी चिदंबरम के ऊपर कानून के लंबे हाथ गए थे. ऐसा प्रतीत हुआ कि इस बार अदालत से एक ऐतिहासिक निर्णय आएगा, लेकिन हुआ इसका ठीक उलट.
शारदा चिटफंड घोटाले में सीबीआई ने आरोप लगाया था कि नलिनी चिदंबरम ने शारदा ग्रुप ऑफ कंपनी के मालिक सुदीप्तो सेन के साथ मिलकर आपराधिक साजिश रची थी और आगे की जाँच के लिए नलिनी चिदंबरम को कानूनी हिरासत में लेने की माँग की थी. देश की बड़ी एजेंसी द्वारा यह अपेक्षित भी था कि वह किसी व्यक्ति के प्रभाव से परे उसके अपराधों की निष्पक्ष जाँच करें. ऐसा लगा कि इस बार नलिनी चिदंबरम को कानूनी हिरासत में लेने के आदेश आएंगे, लेकिन मद्रास हाई कोर्ट ने इस मामले में सीबीआई द्वारा नलिनी चिदंबरम को कानूनी हिरासत में लेने से तब तक मना कर दिया, जब तक उनको पश्चिम बंगाल की अदालत से ज़मानत मिल रही है. मद्रास हाईकोर्ट के न्यायाधीश जीके इलंथीरैयन ने 4 हफ्ते की अंतरिम जमानत देते हुए नलिनी से कहा कि वह मुख्य न्यायिक मजिस्ट्रेट के सामने समर्पण करें. इसके बाद वह नियमित अग्रिम जमानत के लिए पश्चिम बंगाल की अदालत से संपर्क करें.
अब आश्चर्यजनक है. कानूनी कार्यवाहियां अपनी जगह है, लेकिन एक अभियुक्त को सज़ा कैसे मिल सकती है जब तक उसको इतनी आसानी से जमानत मिल जाए? एक आरोपी को जाँच के दायरे में लाना आवश्यक है. न्याय भी यही कहता है. लेकिन इस केस में आरोपी को लगातार ज़मानत मिल रही है.
कभी कभी तो रविवार को ज़मानत अर्ज़ियाँ मंजूर कर ली जा रही हैं, जब अदालती कार्यवाही ठप्प रहती हैं. यह अच्छी बात है कि रविवार भी देश की अदालतें काम कर रही हैं, लेकिन जब एक आरोपी की ज़मानत के लिए न्याय के दरवाजे खुलने लगे तो लोगों के बीच सवाल अपने आप उत्पन्न होने लगते हैं.
दूसरी तरफ नेशनल हेराल्ड केस की भी सुनवाई में ‘तारीख पर तारीख’ वाला डायलाग चस्पा कर दिया गया है. सवाल ये है कि जब सुनवाई होगी ही नहीं तो न्याय का रास्ता कहाँ से खुलेगा? न्यायधीश महोदय के आदर सम्मान में शब्दों की कोई कमी न रहे, इसका वो पूरा ध्यान रखते हैं. दूसरी तरफ ‘कंटेंप्ट ऑफ कोर्ट’ का खतरा भी आम लोगों पर मंडराता रहता है. तो कोई सवाल नहीं उठाता है. पहले खुद को बचाना सबकी प्राथमिकता होती है. कोई कानूनी चंगुल में फंसना नहीं चाहता है. मगर अंदर एक टीस तो उठती ही है कि कैसे भ्रष्टाचार करने वाले आराम से जमानत लेकर चले जाते हैं. बड़े लोगों के भ्रष्टाचार की सुनवाई में न्याय की जगह तारीखें मिलती हैं. राम मंदिर विवाद पर तो न्याय की बाट जोहती कितनी ही पुण्य आत्माएं परलोक की यात्रा पर चली गयी, लेकिन राम मंदिर विवाद वैसे ही खड़ा है.
यह भारत की जनता के बीच न्याय व्यवस्था से विश्वास उठा देने वाले निर्णयों में से एक लगते हैं. लोकतंत्र का एक स्तंभ न्यायपालिका भी है. इस स्तंभ की मजबूती पर करोड़ों लोगों का वह विश्वास खड़ा है जो कहता है कि मुझे अपने देश के कानून पर पूरा भरोसा है.
यह भरोसा अब डगमगाने लगा है. इस भरोसे को दोबारा स्थापित करने की ज़िम्मेदारी भी न्यायापालिका की ही है. उम्मीद यही है कि न्याय की देवी के उपास इस गंभीर स्थिति पर चिन्तन मनन करेंगे.
