देश की स्वतंत्रता के समय हुए बटवारे में लाखों लोग शरणार्थी बनकर भारत आए थे. ये लोग देश के कई भागों में बसे व आज वहीं के स्थायी निवासी कहलाते हैं. किन्तु जम्मू-कश्मीर में स्थिति विपरीत है. यहां आज भी दशकों पहले बसे लोगों की तीसरी-चौथी पीढ़ी भी शरणार्थी ही कहलाती है जहाँ इन्हें मौलिक अधिकारों से वंचित रखा जाता है. अनुच्छेद 35A इन्हीं शरणार्थियों से सम्बंधित है. 35A सदैव ही विवादित अनुच्छेद रहा है.14 मई 1954 को तत्कालीन राष्ट्रपति द्वारा एक आदेश पारित किया गया था. इस आदेश के जरिये भारत के संविधान में एक नया अनुच्छेद 35A जोड़ा जाना था, जो कि अनुच्छेद 370 का उपबंध है. इसे संविधान में संशोधन के जरिए नहीं बल्कि ‘अपेंडिक्स’ के रूप में शामिल किया गया था. अनुच्छेद 35A को न तो लोकसभा में पेश किया गया था न ही राज्य सभा में. इसे मात्र राष्ट्रपति के आदेश के द्वारा ही अनुच्छेद 370 में जोड़ दिया गया था. संविधान के अनुच्छेद 368 के अनुसार यह संसद से पारित नहीं हुआ, इसलिए एक अध्यादेश की तरह यह 6 महीने से अधिक लागू नहीं रहना चाहिए था, किन्तु यह आज भी बरकरार है.
अनुच्छेद 35A ऐसा प्रावधान है जो जम्मू-कश्मीर विधानमंडल को यह अधिकार प्रदान करता है कि वह तय करे कि जम्मू-कश्मीर का स्थायी निवासी कौन है. किसे सार्वजनिक क्षेत्र की नौकरियों में विशेष आरक्षण दिया जायेगा व किसे संपत्ति खरीदने का अधिकार होगा. चुनाव में वोट डालने का अधिकार किन लोगों को होगा तथा छात्रवृत्ति तथा अन्य सार्वजनिक सहायता और सामाजिक कल्याण कार्यक्रमों का लाभ किन्हें मिलेगा. अनुच्छेद 35A में यह प्रावधान है कि यदि राज्य सरकार किसी भी कानून को अपने हिसाब से बदल सकती है लेकिन उसे किसी भी कोर्ट में चुनौती नही दी जा सकती.
अनुच्छेद 35A जम्मू-कश्मीर को राज्य के रूप में विशेष अधिकार भी देता है जिसके तहत दिए गए अधिकार स्थाई निवासियों से जुड़े हुए हैं. अर्थात् राज्य सरकार को ये अधिकार है कि वो किस व्यक्ति को वहाँ का नागरिक माने व किसे नहीं.
इसके अतिरिक्त अनुच्छेद 35A के अनुसार यहां का नागरिक केवल वह ही माना जाएगा जो 14 मई 1954 को राज्य का नागरिक रहा हो या उससे पहले के 10 वर्षों से राज्य में रहा हो या इससे पहले या इस दौरान यहां पहले ही संपत्ति हासिल कर रखी हो. यह अनुच्छेद किसी गैर कश्मीरी व्यक्ति को कश्मीर में जमीन खरीदने से रोकता है. साथ ही दूसरे राज्य का नागरिक यहाँ का निवासी नहीं बन सकता. जम्मू-कश्मीर में रह रहे लोग जिनके पास स्थायी निवास प्रमाणपत्र नहीं है, वे लोकसभा चुनाव में तो वोट कर सकते हैं, किन्तु स्थानीय निकाय चुनाव या विधानसभा चुनाव में वोट नहीं दे सकते हैं. इस अनुच्छेद के अनुसार जम्मू-कश्मीर की लड़की किसी अन्य राज्य के लड़के से शादी कर लेती है तो उसके सारे अधिकार खत्म हो जाते हैं. स्पष्ट है कि यह अनुच्छेद भारत के नागरिकों के साथ भेदभाव करता है क्योंकि इस अनुच्छेद के लागू होने के कारण भारत के लोगों को जम्मू-कश्मीर के स्थायी निवासी प्रमाणपत्र से वंचित कर दिया गया, जबकि पाकिस्तान से आये घुसपैठियों को नागरिकता दे दी गयी.
